- What these terms cover. These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content.
- Why you should read them. Please read these terms carefully. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.
- When these terms begin. These terms and conditions will become binding on you when:
- you have signed them or, if you are accessing them on the Lvl5 app, once you have indicated your acceptance in the declaration section of the sign up process in the app; and
- we confirm your membership application has been accepted, at which point a contract will come into existence between you and us.

- Who we are. We are Lvl 5 Gyms Limited, a company registered in England and Wales. Our company registration number is 13550312 and our registered office is at Enterprise House, Tir Llwyd, Enterprise Park, Kinmel Bay, Rhyl, Wales, LL18 5JZ. Our registered VAT number is [NUMBER].
- How to contact us. If you have any questions or complaints, please contact us by emailing us at info@lvl5gyms.com.
- How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us when you joined.
- “Writing” includes emails. When we use the words “writing” or “written” in these terms, this includes emails.

Your membership rights

- We offer various types of adult membership to persons aged 16 or over and child memberships for persons under 16 years of age.
- The facilities and services available to you and the amount you pay will depend on the type of membership you have chosen. Details of what you are entitled to under each membership type is set out at part B of these terms and conditions.
- Each category of membership may have certain restrictions which only apply to that category of membership. We will tell you about these restrictions when you join or when you change your category of membership.

Membership types, credits and extras

Details of all membership types and the fees payable in respect of them are set out at part B of these terms and conditions.

Day Pass
- If you opt for a Day Pass, your membership will commence once you have indicated your acceptance to these terms and conditions and will run until the gym closes on that day.
- You cannot transfer a Day Pass to anybody else.
- Day Passes are non-refundable.

Weekday Pass
- With this membership option, your membership will commence on the day you have indicated your acceptance to these terms and conditions or, if that is on a weekend, it will commence on the next working day. The membership will run for a period of five week-days (meaning, for the purposes of these terms and conditions any day other than a Saturday and Sunday).
- You cannot transfer a Weekday Pass to anybody else.
- Weekday Passes are non-refundable.

Weekend Pass
- With this membership option, your membership will commence on the day you have indicated your acceptance to these terms and conditions or, if that is a weekday, it will commence on the following Saturday. The membership will run for one weekend (meaning, for the purposes of these terms and conditions one Saturday and one Sunday).
- You cannot transfer a Weekend Pass to anybody else.
- Weekend Passes are non-refundable.

Open Gym, Group Training and Small Group Training Monthly Memberships
- With these monthly membership options, you commit to be a member and pay a monthly membership fee for at least one full calendar month;
- After the full calendar month has elapsed, your membership continues on a monthly basis, but you can cancel it in line with section 8.

Open Gym, Group Training and Small Group Training 6 Month Paid In Full (“PIF”) Membership
- With these membership options, you commit to be a member for 6 months, beginning on the date your membership commences, and to paying all of your membership fee upfront when you join or renew; and
- If you do not wish to renew your membership on the expiry of the 6 months you have committed to, you must inform us at least 7 days prior to the expiry of those 6 months.

Open Gym, Group Training and Small Group Training 12 Month PIF Membership
- With these membership options, you commit to be a member for 12 months, beginning on the date your membership commences, and to paying all of your membership fee upfront when you join or renew; and
- If you do not wish to renew your membership on the expiry of the 12 months you have committed to, you must inform us at least 7 days prior to the expiry of those 12 months.

Online PT
- Members can book online personal training and coaching sessions with our personal trainers, to be held via video via an online video conferencing service such as Zoom, Microsoft Teams or Facetime.
- Additional charges apply for any online PT sessions which members book. Prices are set out at Part B of these terms and conditions.

Extras
- Members are able to pay for extra services and products which we offer. Details of the extras services and the fees payable in respect of them are set out in the extras section of part B of these terms and conditions.

payment methods & discount
-
- If you have chosen a prepaid membership option (including a day pass, a weekday pass or a weekend pass), you must pay the full membership fee payable for that membership (as set out at the end of these terms and conditions) at or prior to the start of your membership. This can be paid via the Lvl5 app, website or in person at our gym.
- If you have chosen a monthly membership, you must pay your monthly membership fee in advance every month, we will take your monthly payment on or around the first day of each calendar month. If your membership begins on a date other than the first day of the calendar month when you join, you will be required to pay a pro-rata amount for your membership until the first day of the following calendar month. By way of example:
If a member joined on a Open Gym monthly membership commencing 22nd March 2022, they would at the time of joining pay a pro-rata’d amount for the period 22nd March 2022 to 31st March 2022. On the 1st of April 2022, their first full monthly direct debit payment of £55 would be made, which would cover the full calendar month of April 2022.

We may, entirely at our discretion, accept other payment methods.

Discounts on any memberships or products are discretionary and must be authorised by a Director of LVL 5 Gyms Limited:

Failing to pay
-

This section is about what will happen if you do not pay your monthly membership fee or any other fees or charges you have agreed to pay because:
- the account details you provided for the direct debit are wrong; or
- there is not enough money available in your bank account; or
- you have cancelled your direct debit without giving us the correct notice period.

If you fail to pay any fees or charges which are owing to us, for the reasons, set out in section 6.1:
- we will ask you to pay by cash, debit card or credit card, and to give us your correct bank details.
- while you owe us payments you will not be allowed to use any of our gyms; and
- if you have not paid the outstanding fees or charges within 7 days of being notified by us and asked for payment in accordance with section 6.2(a), this will be deemed as notice to cancel your membership.

We may appoint a debt collection agency to collect any payments you owe us, and you may have to pay any costs associated with this, including legal and court costs and interest. Alternatively, we may choose to take payments owed to us from your credit card or debit card using the debit card or credit card details you have given us, and you hereby authorise us to do so.

We may disclose your personal details to any credit reference agency or third party instructed to recover any arrears under these terms and conditions.

Freezing your membership
-

-
You may temporarily put your membership on hold for between one and twelve calendar months for the following reasons only. We may require you to produce proof which is satisfactory to us of any of these reasons that you are relying on to freeze your membership:
- pregnancy;
- serious illness;
- serious injury; and
- redundancy.
- Moving in excess of 20 miles away from the facility

Putting your membership on hold is not the same as cancelling your membership. It is a temporary suspension, while cancellation is the termination of your membership. To cancel your membership you must follow the procedure set out in section 8.

If you want to put your membership on hold, you can request us to do so in writing, by emailing us at info@lvl5gyms.com.

If we receive your request in accordance with section 7.3, and agree to put your membership on hold, we will confirm this in writing to you and your membership will be on hold from the day that we give such confirmation to you.

If you have chosen any of our PIF memberships, we will extend your membership period by the number of months your membership is on hold for. If we increase our prices during the period when your membership is on hold, you may be required to pay any new or additional prices that apply to your membership type when your membership resumes.

You will not be allowed to use our facilities while your membership is on hold, with exception of the coffee/smoothie bar.

cancellation
-

You have a legal right to change your mind and cancel your membership within 14 days of joining. The 14-day cancellation period commences the day of your membership start date. This is called the ‘cooling-off period’. If you choose to cancel within the cooling off period we will give you a refund of any fees you have paid, less an amount for the membership you have already used.

If you want to cancel your membership at any time, you must give at least 7 days’ notice in writing to us at info@lvl5gyms.com.
-
If, after the cooling-off period, you tell us in writing that you wish to cancel your membership in accordance with section 8.2, we will send you an acknowledgement letter or email to confirm the date your membership will end. If you do not receive this acknowledgement, you must assume that we have not received your cancellation notice and you must contact us and send a further cancellation notice to us.

If you cancel an Open Gym PIF membership before the expiry of the term to which you have committed to, we will refund the membership fee you paid less £55 per month for the period up to the last day of the calendar month on which your membership terminates. By way of example only:

A member signs up for a 12 Month Open Gym PIF Membership and pays an upfront fee of £495 at the point of joining on 1st January 2022. They notify us via email, on 22nd April 2022, that they wish to cancel their membership as soon as possible. We acknowledge receipt and confirm to the member that their membership will expire on 30th April 2022 (the last day of the calendar month in which the member provided 7 days’ notice of cancellation).
As the member cancelled before the expiry of the 12-month period they committed to at the outset, the fee payable for the period of 1st January 2022 to 30th April 2022 (4 months) would be calculated as £55 per month, i.e. our monthly membership fee for 12 Month Open Gym PIF Memberships. We would therefore refund the sum of £220 to the member and retain £275 as payment for the four months of membership which elapsed up to and including the point of cancellation.
- If you cancel a Group Training PIF membership before the expiry of the term to which you have committed, we will refund the membership fee you paid less £99 per month for the period up to the last day of the calendar month on which your membership terminates.
- If you cancel a Small Group Training PIF membership before the expiry of the term to which you have committed, we will refund the membership fee you paid less the £169 per month for the period up to the last day of the calendar month on which your membership terminates.
- Monthly Open Gym, Group Training and Small Group Training Monthly Memberships, can be cancelled by providing us with at least 7 days’ notice in writing, by email to info@lvl5gyms.com. Provided you have given us at least 7 days prior notice, your membership will terminate automatically on the last day of your monthly membership period (but not the last day of that calendar month). If you do not provide us with at least 7 days’ notice prior to the end of your monthly membership period, your membership will continue to run and will terminate automatically on the last day of the following monthly membership period. By way of example only:
A member signs up for a Open Gym monthly membership on 12th January 2022 and agrees to pay every month. Their monthly membership period, therefore, runs from the 12th of the month until the 11th of the following month. On the 12th of the following month, their monthly membership renews for another month.
The member decides on the 3rd March 2022 to cancel their membership. They email us at info@lvl5gyms.com to notify us, and we acknowledge that their membership will therefore terminate on 11th March 2022, being the final day of their monthly membership period.
If the member had only notified us on 9th March 2022 of their intention to cancel their membership effective from 11th March 2022, this would not provide us with the required 7 days’ prior notice before the end of their monthly membership period. As such, their membership would continue running until the last day of their next monthly membership period, 11th April 2022, at which point it would be cancelled.

Cancelling your payments does not mean you have given us notice to end your membership. You must give us written notice in line with the terms of these terms and conditions.

In order to cancel any appointments for personal training sessions, classes or any of the extras set out in Part B of these terms and conditions you must provide us with not less than 4 hours’ notice prior to the appointment or class.

If you have booked personal training sessions or classes using credits, but cancel your booking, we will only refund your membership account with the amounts/sessions relating to those classes if you have cancelled them in accordance with this section, by providing us with sufficient notice.

If you have booked and paid for any extras, but cancel your booking, we will only refund you for the extras which you cancel if you have done so in accordance with this section, by providing us with sufficient notice.

We reserve the right to refund members who cancel appointments for classes or personal training sessions on less than 4 hours’ notice in exceptional circumstances and at our absolute discretion.

If you wish to cancel any extras which you have purchased, any payment made for those extras may be refunded within 14 days of purchase, provided the credits have not been used or redeemed. We will refund you for any unused extras you wish to cancel within this period provided you give us at least 7 days’ notice in writing to us, by email to info@lvl5gyms.com.

Our rights to make changes
-

If we decide to change the location of our gym or to close it permanently, the following will apply:
- we will make every reasonable effort to give you at least 3 months’ notice of the change or closure (either in writing or by displaying a notice at the relevant gym);
- you can end your membership by providing us with 7 days’ prior notice in accordance with the cancellation provisions set out at clause 8 of these terms and conditions;
- If we cannot give you 3 months’ notice of the change or closure but you want to end your membership, you can give us a written notice which ends on the date when the changes start to apply. We will refund any part of your membership fee you have already paid for a period after that date.

We have the right to increase, reduce or withdraw certain facilities, services or activities in any of our gyms either permanently or temporarily (for example, to carry out cleaning, repairs, maintenance or security work).

If we decide to permanently withdraw the whole of our gym facilities, we will make every reasonable effort to give you one month’s notice in writing.
-
If we decide to make any other change to the facilities, services and activities available at our gym, we will give you notice by displaying the notice at the relevant gym if this is reasonably possible.

If the gym is closed for more than 7 days in a row and we do not provide another facility (this may be a facility with fewer services or a temporary facility) somewhere up to 10 miles from the gym, we will refund a percentage of your membership fees which relate to the period that your gym is closed. This does not apply if we have to close the facility due to reasons outside our control.

If we have to close our facilities for reasons outside our control, we will try our best to provide other facilities or consider whether we should extend your membership by such length of time which is equal to
- the length of time our facilities are closed; and
- the period for which we are unable to provide a suitable alternative.

We will display details of the opening and closing times for our gyms in the reception areas. Opening times may vary during the Christmas period and on other bank holidays.. We will try to give you at least one month’s notice if we reduce the opening hours of any of our gyms.

We may increase membership fees automatically each year by either 1% above the rate of inflation according to the Retail Prices Index or 3%, whichever is higher.

If we plan to increase membership fees by more than the higher of these amounts, we will make every reasonable effort to give you at least one month’s notice. We will give you notice of the change by writing to you and by displaying a notice at the gym.

As well as the increase described at section 9.8, we have the right to increase membership fees at any time to take account of any increase in the rate of VAT. We will make every reasonable effort to give you at least one month’s notice of the increase (either in writing or by displaying a notice at the gym).

We may make reasonable changes to these terms and conditions, to the membership details and fees set out at Part B and to the rules set out at Part C and displayed in the gym, at any time, as long as we give you notice before we make the changes.

At any time, you can end your membership in accordance with section 8 of these terms and conditions if we give you notice under section 9.8 of an increase in your membership fee of more than either 1% above the rate of inflation or 3%, whichever is higher. The rate of inflation means the Retail Prices Index All Items 12-month percentage change published by the Office for National Statistics for July before the date on which we give you notice.

Our rights to end the contract

We will not tolerate our staff or other members being verbally abused or physically threatened. If we find this to be the case, we have the right to report you to the police, ban you immediately and permanently from our gyms and cancel your entire membership.

We may also cancel your entire membership with immediate effect in the following circumstances:
- if you breach these terms and conditions or the gym rules and you do not, or cannot, put it right within 7 days of us writing to you about it;
- if, with your knowledge or permission, another person uses your membership to access our gyms;
- if you use rude or abusive language or behave or threatening to behave in a violent or aggressive way at any of our gyms.

If we receive any complaint about your behaviour or if you persistently behave inappropriately, or if we believe that your continued membership is not in the interests of other members of the gym, we have the right to suspend your membership. You have the right to appeal against our decision (unless your behaviour is covered by 10.1 or 10.2 of these terms and conditions) by way of email to us at info@lvl5gyms.com within 14 days of us suspending your membership. If the issue is not resolved following your appeal, or if you do not appeal, we have the right to cancel your membership.

If we cancel your membership for any of the reasons in clauses 10.1 to 10.3, we have the right to keep a proportion of the money you have paid under this agreement to cover any reasonable costs we have had to pay. We will also not accept any future applications you make for membership to any of our gyms and you will not be allowed to enter our gyms as a guest or for any other reason.

We are committed to ensuring members are satisfied with the services and facilities we provide, but we know that things don’t go to plan all the time. If you have a complaint, we want to know about it as soon as possible so that we can investigate it and resolve the matter.

If you have a complaint, you should first tell a member of staff at the gym. If you are not satisfied with their response, you should contact the manager on duty at the gym. If you are still not satisfied, you can write to us at our head office at Lvl 5 Gyms, Enterprise House, Tir Llwyd Enterprise Park, Kinmel Bay, Rhyl, Wales, LL18 5JZ.

We do not accept liability for damage or loss to your property or a guest’s property that may happen on the premises or within the grounds of our gyms.

We do not accept liability for the injury or death of any member or guest that may happen on the premises or within the grounds of our gyms.

Nothing in these terms and conditions is meant to limit any rights you might have as a consumer.

We will deal with all information we hold about you in line with our privacy policy, which you can obtain from the LVL 5 Gyms Limited app, from our website at www.lvl5gyms.com and from our gyms.

We will only give your personal information to third parties where the law requires or allows us to do so and in accordance with these terms and conditions.

Other important terms
-
-
We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

You are not entitled to transfer your rights or obligations under these terms to any other person.
-
This contract is between you and us. No other person shall have any right to enforce any of its terms.
-
Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
-
If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

general health and safety

You must not use or visit the gym if you have an infectious illness or condition, or live with anyone showing any symptoms of Covid-19.

You must wash or sanitise your hands thoroughly on entering the gym and regularly while in the gym.
-
You must wipe down the kit once you have used it, with the cleaning products provided. Cleaning stations and wipes are available in the gym for you to use.
-
If you are unsure as to how to use any piece of equipment you must scan the relevant QR code on the equipment for guidance and a short virtual demonstration before using that equipment. If you are still unsure as to how to use that piece of equipment, or unable to use the QR code, you must seek advice from a member of staff before using it.

As your safety is our main priority, we do not allow crockery or glassware inside the gym.
-
We do not allow animals (except for assistance dogs) in the gym.
-
To protect the safety of all members and guests, you must pay particular attention to all signs relating to health and safety in our gyms. If you do not understand a notice or sign please ask one of our team members at the gym.
-
Fire exits are clearly marked throughout the gym. If there is a fire or if you hear the fire alarm, you should make your way out of the gym through the nearest possible exit to the advertised assembly point.

If you suffer an accident or injury on our premises, you must report it and the circumstances under which it happened to the senior manager on duty immediately.
-
For legal and health reasons, smoking and e-cigarettes are strictly prohibited in all areas of the gym.
-
While you are at the gym we expect you to behave appropriately, respectfully and politely, and to dress appropriately at all times. We can prevent you from entering the gym or ask you to leave if we think your behaviour or appearance is inappropriate.

For safety reasons, bags are not permitted on the gym floor and correct attire must be worn when exercising, i.e. suitable comfortable exercise clothing and appropriate footwear. Clothing such as jeans, boots, flip-flops, sandals or workwear are not permitted. Football tops may also not be deemed appropriate in the gym. Any member not wearing suitable attire may be asked to leave the gym.

You must not use or visit the gym whilst under the influence of alcohol, narcotics, tranquillisers or any medication or other substance which may affect your ability to exercise safely. We reserve the right to remove you from the premises if we reasonably believe you are unfit to use the facilities.

Members must return weights to their original place when finished using them. Failure to do so may result in membership being terminated.

There is no on-site parking available; you may use the nearby parking at Parc Llandudno (2 hour max stay) or Asda (4 hour max stay)

You park in the car park at your own risk. We do not accept liability for any loss or damage to your car, or personal belongings within it.

Lockers
-
-
-
You bring all personal belongings to the gym at your own risk. We do not accept legal responsibility for any loss or damage to these items.

If you leave your belongings in a locker overnight we have the right to remove your belongings. You can claim the belongings we have removed from the gym reception for up to 3 weeks after we remove them. After this time, we will give these items to charity or, where appropriate, destroy them.

If you find lost property, you must hand it into the gym reception immediately. We will hold items for 3 weeks only before giving them to charity.
- Any damp or wet items found will be disposed of immediately

Before you start using the gym or any fitness equipment, we will ask you to read a health commitment statement and have an introduction with one of our qualified coaches to establish relevant training and fitness experience and ability.

If you have concerns about your physical condition, you must not do strenuous physical activities without first getting medical advice.

To make sure you get the most from every activity you do at the gym, you should always ensure that you warm up properly and take time to cool down after your activity.

You should not take part in any physical activity that you may not be fit for. You are responsible for monitoring your own condition during physical activity.

You should tell the general manager, a qualified coach or a member of our team when you join about anything relevant to your physical condition. You should continue to keep this information up-to-date throughout your membership.

You are responsible for monitoring your own physical condition. If you suffer any unusual symptoms, you must immediately stop the activity and tell a member of staff at the gym.

You may take photographs and video recordings in the gym for your own personal use, provided you observe these rules and any extra rules displayed at the gym.

You must not take photographs or videos on the premises or post remarks on the internet that may identify another member of the gym without their prior permission.

You must not take photographs or video recordings in any changing area or toilet.

If another member is unhappy that you are filming or photographing them and makes a complaint to us, we may ask you to show us any images or videos you have taken in the gym and delete them if appropriate.

If a member of our team asks you to stop filming or taking photographs you must do so.

Classes

Members must arrive promptly for class start times. Late arrival may result in being refused entry to the class.

We operate a three-strike non-attendance rule, whereby three no-shows at classes within a 28 day rolling period results in a 10 day booking ban. Any future classes you have booked will also be cancelled. You must cancel your class at least 4 hours before it starts or this will be recorded as a no-show.

Our classes get full. If you are unable to attend you should cancel in advance according to these rules in order to avoid a strike.
